The petitioner seeks bail in connection with Teghra Police Station Case No. 132 of 2017 registered for the offences punishable under sections 147, 448, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.
The allegation as per the written report is that altogether 07 FIR named persons came at the house of the informant where altercation took place and both the parties indulged in scuffle for which two cases were lodged. A police case vide Teghra Police Station Case No. 131 of 2017 has been registered from the side of petitioner on the written report of coaccused Anjali Devi. In the said occurrence, the informant
Patna High Court Cr.Misc. No.56667 of 2017 (2) dt.12-12-2017 2/2 sustained simple injury. The allegation against the petitioner is that he assaulted the informant by Farsa causing injury on her head. It has been submitted that the injury alleged was found simple in nature and so no case is made out against the petitioner. Learned counsel for the opposite party opposed the submission.
On perusal of FIR and injury on record it appears that this petitioner has allegedly given one Farsa blow on the head of the informant but the injury report shows that the injury was simple in nature. The petitioner having clean antecedent is in custody since 27.05.2017.
Considering the nature of injury, case and counter case, the prayer for bail of the petitioner is allowed and the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Teghra Police Station Case No. 132 of 2017.
