JUSTICE SUDHIR SINGH ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 406, 409, 467, 468, 471, 419, 420, 273 and 120B of the Indian Penal Code.
Allegation against the petitioner is that he runs his business in the name Jodhani Food Pvt. Ltd. and in the business premises during raid 725 bags of wheat were found having F.C.I. mark. Two trucks loaded with wheat bags were also found. It is further alleged that in total 8 trucks of illegally procuring wheat was received by the company.
It is submitted on behalf of the petitioner that he has got no criminal antecedent. He is the owner of two trucks loaded with wheat which were found standing in front of his house. It was suspected that those wheat bags were of the Bihar State Food Corporation. On the basis of the same a proceeding was initiated against him. The said wheat bags in question have been claimed
Patna High Court Cr.Misc. No.15679 of 2016 (2) dt.03-05-2016 2/2 by the petitioner and the same have been directed to be released in favour of the petitioner with certain conditions vide order dated 16.3.2016 passed in C.W.J.C. no. 4662 of 2016. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl Chief Judicial Magistrate-IXth , Bhagalpur, in connection with Industrial P.S. Case no. 12 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
