This is a case registered under Sections 414, 34 of Indian Penal Code and sections 20/22 of the NDPS Act. Counsel for the petitioner submits that on similar allegation of recovery of 2 packets of Smack of 1 gm each, coaccused Ravi Kumar has already been granted bail vide order dated 20.12.2017, passed in Cr Misc No. 60845 of 2017. He submits that the petitioner is not concerned with recovery of smack and the motorcycle in question is not stolen property rather it has been given to Ravi Kuamr by one Gyatri Devi. The seizure is also not in accordance with law and the petitioner is in custody since 21.10.2017.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be

No.611 of 2018 (2) dt.10-01-2018 released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in Pirbahore Police Station Case No. 592 of 2017 on the following conditions:- (a) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner.

(b) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
