JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-01-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 05.11.2014 and the trial court vide its letter no. 11 dated 18.01.2018 has reported that up till now the trial of the petitioner is pending for recording the prosecution evidence.
However, the learned trial court has further reported that all the material witnesses including I.O and Doctor except one unofficial witness Mahesh Tanti have already been examined and the prosecution has taken short adjournment with assurance to produce the aforesaid witness Mahesh Tanti. The learned trial court has also reported that a short adjournment has been given to prosecution with warning that the prosecution evidence shall be
Patna High Court Cr.Misc. No.59337 of 2017 (4) dt.31-01-2018 2/2 closed by the next date. It would appear from report of the learned trial court that the trial of the petitioner is on the verge of conclusion. Therefore, in the aforesaid circumstance, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Session trial no. 58 of 2016 arising out of Muffasil P.S.Case No. 189 of 2014, pending in the court of learned Additional Session Judge 1st, Munger stands rejected.
