The petitioner seeks bail in connection with Rajgir P.S. Case No. 129 of 2017 dated 07.06.2017 instituted for the offence under Sections 414/34 of the Indian Penal Code. On secret information that some miscreants have assembled at a place for the purposes of selling stolen motorcycles, a raid was conducted. Three motorcycles were recovered from the place where the raid was conducted. From the possession of the petitioner, one mobile phone and master keys of motorcycles were recovered.

Learned counsel for the petitioner has submitted that the owner of the place from where the motorcycles have been recovered has been granted bail by a Bench of this Court. That

No.57197 of 2017 (3) dt.21-12-2017 2/2 apart, it has also been submitted that there is no statement in the entire investigation papers regarding the theft of the motorcycles which have been recovered in the present case. Though the petitioner has been made accused in as many as seven cases of similar nature registered under Section 379 of the Indian Penal Code, but according to the learned counsel for the petitioner, in all such cases, he is on bail and in this case also, the petitioner has only been made accused because of his not having good antecedents.

Regard being had to the fact that petitioner has remained in custody since 08.06.2017, this Court is inclined to grant bail to him.

The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P.S.
