Petitioner seeks bail in a case registered for the offences punishable under Sections 20 and 22 of the N.D.P.S. Act.
From a hidden box beneath the back side of the seat of the referred four wheeler 4.4 Kg of Ganja was recovered by the Police. Co-accused was driving the vehicle and on his disclosure recovery was made.
Submission of the learned counsel for the petitioner is that petitioner simply got lift from the said car driver to reach his destination and he had no knowledge about the Ganja lying in the vehicle. The petitioner has got no criminal antecedent. He
Patna High Court Cr.Misc. No.30204 of 2018(6) dt.07-08-2018 2/2 has got no concern with the vehicle or Ganja, which the petitioner has stated on oath. The petitioner is in custody since 02.02.2018. Investigation of the case is already complete. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Dumariyaghat Police Station Case No.16 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
