JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2019 Petitioner seeks bail in anticipation of her arrest in connection with Siswan P.S. Case No. 104 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and sections 30(A) and 38(B) of Bihar Prohibition and Excise Act.

Prosecution case is of recovery of 13.200 litres of liquor from the house of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated, nothing has been recovered from his house and he has no criminal antecedent. Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that recovery is made from the house of the petitioner.

In view of above facts and circumstances, I am not

He may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day. With the above observation, this application is dismissed.
