The issue raised in the present writ application on behalf of the petitioners has been vexing them and the State, right from the year 2000.
The affidavit filed on behalf of the State, especially the Agricultural Department surely establishes the fact that the State has been callous, negligent and has been dragging their feet on the issue by putting off matter indefinitely. This is what the State accept in paragraph nos. 7, 8 and 9.
Patna High Court CWJC No.22284 of 2014 dt.14-09-2016 2/2 The grievance of the petitioners, therefore, is bona-fide and needs consideration and a decision, which has not been done for more than a decade and a half.
The time has come when the State must deliver. Writ application is disposed off with the direction upon the Agricultural Production Commissioner that he has to take final decision with regard to grievance of these petitioners within the period of three months from the date of communication / production of a copy of this order. Such a direction has been passed keeping in view that a meeting was convened and process initiated as far back as 11.06.2015, but when a counter affidavit is filed on behalf of the State on 14.09.2016, nothing is indicated as to what has happened since then.
Writ application stands disposed off in terms of the above.
The Court would also expect the APC to stick to the time-frame indicated by the Court above.
