The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 489A, 489C of IPC. Allegation against the petitioner is that she gave Rs.1100/- (95 notes of 10 denomination and five notes of 20 denomination) to the informant and requested him to give her currency of big denomination. At the request of the petitioner, the informant gave her 11 currency notes of 100 denomination and she moved away. After sometime it came to the notice of the informant that notes given by the petitioner were fake and he informed police. Notes were shown to the Manager of the Bank who also certified that they were fake notes. Learned counsel for the petitioner submits that fake notes have not been recovered from the possession of the petitioner and the notes recovered from the possession of the

However, after investigation charge-sheet has already been submitted and there is no chance of tampering with the witnesses. The petitioner is a lady and has been in custody since 26.10.2014 and there is no chance of concluding the trial in near future.

Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned SDJM, Birpur (Supaul)/ court concerned in Birpur (Balua Bazar) P. S. Case No. 204 of 2014 after framing of charge with following conditions:-

1. The petitioner will not indulge herself in similar or any other offence.

2. One of the bailors must be the close relative of the petitioner.

3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, her bail bond would be liable to be cancelled by the learned Court concerned.
