The petitioner apprehends his arrest in connection with Sathi P.S. Case No. 147 of 2018, registered under Sections 144, 341, 342, 323, 353, 427, 504 and 506 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Bettiah, West Champaran.
The accusation is that informant being the Assistant Electric Engineer, Electric Supply, Sub-Division, Narkatiaganj was informed by his driver Ramesh Kumar on mobile that in the leadership of Jitendra Kumar Das (Petitioner) 25 to 30 villagers were obstructing the employees working in the Power House of electric sub-centre and they also blocked the sub-centre and employee Ramesh Kumar has been
Patna High Court CR. MISC. No.52862 of 2019(2) dt.23-08-2019 2/2 confined. Thereafter, informant sent the message to Police Station then Ramesh Kumar, anyhow, was managed to carry by the Police. Thereafter, informant opened the door of sub-centre then found log book and other document kept on the table were torn and glasses of the window and other articles were found damaged.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
