The petitioner is the husband who is in custody since 31.01.2017 in connection with Shikarpur P.S. Case No. 235 of 2015 registered for the offence punishable under Sections 304(B)/201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is the husband in a case under Section 304(B) and the entire case is false and fabricated and the informant's side had participated in the cremation proceeding, but as an afterthought came and lodged the case making false and frivolous allegations against the petitioner. Learned counsel for the petitioner further submits that charge has already been framed and the matter is pending for evidence.

Considering the fact that the petitioner is the

Patna High Court CR. MISC. No.55480 of 2019(2) dt.18-09-2019 2/2 husband, I am not inclined to grant regular bail to the petitioner. It is accordingly, rejected with the direction to the concerned Court to expedite the trial so as to conclude the same positively by the 15th of April, 2020. The trial of the case must proceed on day-to-day basis and neither of the parties will be allowed to take unnecessary adjournments.
