ANJANA PRAKASH ORAL ORDER 08-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in Bahadurpur P.S. case No.407 of 2012 registered under Sections 341, 325, 307, 504, 379/34 of the Indian Penal Code and 3(x) of the SC & ST (Prevention of Atrocities) Act, pending in the court of the Chief Judicial Magistrate, Darbhanga.
The Petitioner was granted anticipatory bail by order dated 17.1.2014 vide Cr.Misc.No.39804 of 2013 but on condition that an affidavit would be filed on his behalf that he has fair antecedents. Since there was one other case pending against him, such an affidavit could not be filed and hence he could not avail the benefit of anticipatory bail.
Be that as it may, since the second application for anticipatory bail is not maintainable, the same is disposed of with
Patna High Court Cr.Misc. No.51178 of 2014 (2) dt.08-07-2015 2/2 a direction to the Petitioner to appear before the court below within six weeks from the date of receipt of this order, which shall consider the fact that the Petitioner on merits had been found fit to be released on anticipatory bail by this court.
