JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 406 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
It is alleged that the marriage of the daughter of the complainant was fixed with petitioner no.1 when the engagement was performed on 12.12.2009 but due to non-fulfilemnt of the demand of Indica Car, the marriage could not be performed. Petitioner nos. 2 and 3 are the parents of petitioner no.1.
Patna High Court Cr.Misc. No.2077 of 2015 (2) dt.19-01-2015 2/2 It is submitted by learned counsel for the petitioners that there is no proof with regard to engagement being performed. Considering the nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Aurangabad in connection with Complaint Case No. 1181 of 2009, subject to the conditions as laid down under Section 438(2) Cr.P.C.
