The petitioner seeks regular bail in connection with Barauni (Chakiya) P.S. Case No.333 of 2017 instituted for the offences under Section 188 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 11.4 litres of illicit liquor from a bag which is said to have been thrown away by the petitioner herein while he was fleeing away. It is submitted by learned counsel for the petitioner that the petitioner is innocent and no recovery has been made from the conscious possession of the petitioner. It is submitted that the
Patna High Court Cr.Misc. No.59223 of 2017 (3) dt.22-12-2017 2/2 petitioner is accused in one another case in which he is on bail. The petitioner is stated to be in custody since 09.09.2017. Considering the nature of accusation, the period of custody already undergone, I deem it proper to enlarge the petitioner on bail. Accordingly, the petitioner named above is directed to be released on regular bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Anil Kumar Sinha, learned Additional Sessions Judge-7th cum-special Judge (Excise), Begusarai in connection with Barauni (Chakiya) P.S. Case No.333 of 2017.
