2. The petitioner is in custody in a case registered for the offence punishable under Section 379 of the Indian Penal Code.

3. As per allegation in the FIR, it is case of theft of the truck by unknown persons.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and petitioner is not named in the FIR and nothing has been recovered from the conscious possession of the petitioner. He next submits that name of the petitioner surfaced from the confessional statement of the other co-accused namely Mahesh Prasad and petitioner

Patna High Court CR. MISC. No.64800 of 2024(2) dt.17-09-2024 2/2 has got clean antecedent as stated in para-3 of the petition and he is in custody since 20.06.2024.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the fact that petitioner has got no criminal antecedent, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned AJCM- III, (West) Muzaffarpur in connection with Kanti P.S. Case No. 297 of 2024.
