The petitioner seeks bail in connection with Giriyak P.S. Case No. 228/2017 dated 19.07.2017 instituted for the offences under Sections 341, 323, 504, 302 and 34 of the Indian Penal Code.

The son of the informant is alleged to have been assaulted by about nine persons including the petitioner. However, in the F.I.R., it has been specifically alleged that because of the assault perpetrated by co-accused Dilip Chaudhary, Nawlesh Chaudhary and Pinki Devi, all of whom are alleged to have assaulted the son of the informant (deceased) on his head by means of iron rod, that the deceased died.

The petitioner is in custody since 20.07.2017.

Patna High Court Cr.Misc. No.57065 of 2017 (2) dt.06-12-2017 2/2 Regard being had to the fact that against the petitioner there is only general and omnibus allegation of assaulting the deceased along with others, this Court is inclined to grant bail to him.

The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XI, Nalanda at Biharsharif in connection with Giriyak P.S.
