2. In the present case, the petitioner seeks bail in connection with Rampur P.S. Case No. 531 of 2024 registered for the alleged offences under Sections 126 (2), 115 (2), 109 (1), 352, 351 (2), 351 (3), 3 (5) of BNS and Section 27 of the Arms Act.

3. As per prosecution case, the petitioner and other coaccused persons fired upon the informant, who did not receive any gunshot injury. Two shell were recovered from the place of occurrence.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner did not open fire either on the informant or

Though there is allegation that five persons opened fire, but only two shell were recovered, which shows the falsity of allegation. The petitioner is having antecedent of fifteen cases and he is on bail in fourteen such cases. The petitioner is in custody since 20.11.2024 and charge sheet has been submitted.

5. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and submission of charge sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya/court concerned in connection with Rampur P.S. Case No. 531 of 2024, subject to the conditions mentioned in Section 480 (3) of BNSS and the following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

Patna High Court CR. MISC. No.55758 of 2025(3) dt.19-11-2025 3/3 (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
