The grievance of the petitioner is that the earned leave of 297 days was due to petitioner but only earned leave of 170 days was paid to him and similarly, the arrear of pension has also not been paid to him.

Learned counsel for the University submits that the petitioner was superannuated from service on 31.01.2006 whereas provision for granting 300 days earned leave came into force w.e.f 15.09.2006 and moreover, the retrial dues of the petitioner are under consideration and the process for the same have already been started by the University.

Patna High Court CWJC No.6029 of 2016 (5) dt.10-08-2017 2/2 In view of the aforesaid submission, this writ petition stands disposed of with direction to respondent no. 3 to ensure the admitted retrial dues of the petitioner within three months from the date of receipt/ production of a copy of this order. However, liberty is granted to the petitioner to approach this Court again, if he is not satisfied with the calculation of his retrial dues made by the concerned officials.
