The petitioner seeks regular bail in connection with Jamalpur P.s. Case No. 173 of 2014 for the offences punishable under section 395 of the Indian Penal Code and Section 27 of Arms Act.

The allegation is regarding unknown accused persons having looted a petrol pump and snatched a sum of Rs.80,000/-. The learned counsel for the petitioner submits that the name of the petitioner has transpired belatedly after six months upon confessional statement made by Santosh Kumar and in fact neither any T.I. Parade has been conducted nor any recovery has been made so as to connect the petitioner with the alleged crime. It is submitted that though the petitioner is an accused

Patna High Court Cr.Misc. No.26666 of 2018 (3) dt.09-07-2018 2/2 in four other cases but he is on bail in all those cases. Lastly it is submitted that other co-accused person has already been granted bail vide order dated 04.07.2018 passed in Cr. Misc. No. 32943 of 2018. The petitioner is stated to be languishing in custody since 22.02.2018.

Having regard to the facts and circumstances of the case, the petitioner above named, is directed to be release on regular bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate in connection with Jamalpur P.S. Case No. 173 of 2014.
