Petitioner is languishing in judicial custody since 25.09.2017 in connection with Pirbahore P.S. Case No. 513 of 2017 for offences punishable under Sections 363, 366-A of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that his sister Misha @ Anuska Kumari, aged 16 years, went for her coaching, but did not return. It is alleged that one Chandan Kumar, with whom she used to talk, has taken her. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history, not named in the First Information Report and just because he is the father of

Patna High Court Cr.Misc. No.56677 of 2017 (2) dt.05-12-2017 2/2 co-accused Chandan Kumar, he has been made accused in the present case. He submits that he is not involved in the said occurrence, the victim girl had a love affair with his son, has since married and also does not know their whereabouts. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Pirbahore P.S. Case No. 513 of 2017.
