2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 272, 273 of the IPC and section 30 (a) , 4(i) of the Bihar Prohibition and Excise Act, 2018.

3. Prosecution case is that 40 liters of country made liquor were recovered from the place of occurrence .

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner.

5. Learned counsel for the State submits that

Patna High Court CR. MISC. No.57623 of 2023(2) dt.31-08-2023 2/2 petitioner has got 5 criminal antecedent of similar nature .

6. Considering the facts of the case as also the fact that petitioner has got 5 criminal antecedent of similar nature , prayer for anticipatory bail is rejected.
