The petitioner seeks bail in Pipra P.S. Case No. 121 of 2014 dated 04.07.2014 instituted under Sections 366, 366 (A) and 120B of the Indian Penal Code.
Learned counsel for the petitioner submits that though he is named in the First Informant Report and the allegation is of kidnapping the minor daughter of the informant but the girl has made statement before the Court under Section 164 of the Code of Criminal Procedure, 1973 that she had gone to her maternal uncle's place on her own free will from where she had gone to the petitioner's house where she is living since the last three years. It is submitted that the petitioner having clean antecedent, is in
Patna High Court Cr.Misc. No.49165 of 2014 (2) dt.20-02-2015 custody since 10.04.2014 Learned A.P.P. opposes the prayer for bail.
Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Pipra P.S. Case No. 121 of 2014. (Ahsanuddin Amanullah, J.) Vats/- U T
