Petitioner seeks bail in a case registered under section 414/34 of the Indian Penal Code.

Petitioner and one Md Asgar Ansari @ Md. Asgar are said to have been caught by the informant when they were going on motorcycle and accordingly, informant lodged this case suspecting that the seized motorcycle was stolen property. Learned counsel for the petitioner submits that, as a matter of fact, the aforesaid motorcycle had been purchased by the petitioner from one Md. Firoz and prior to institution of the present case, no case has been lodged regarding theft of the aforesaid motorcycle. No doubt, petitioner appears to have some criminal antecedent but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail
