The petitioner seeks bail in a case instituted for the offences under Sections 120(B)(1), 115/34 of the Indian Penal Code.

Prosecution allegation, in short, is that the accused persons were arrested while they were planning to kill a lady and his son.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.4.2019. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the

Patna High Court CR. MISC. No.54178 of 2019(2) dt.28-08-2019 2/2 present case. There is no substantive evidence to suggest his implication in the present case. Except for the disclosure made by the co-accused, there is no other circumstantial evidence to suggest his participation in the alleged crime. Other co-accused has been granted bail vide order dated 22.8.2019 passed in Cr. Misc. No. 50308 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Begusarai in connection with Muffasil P.S. Case No. 155 of 2019.
