The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 406, 420, 506 of the Indian Penal Code.

As per prosecution case, the allegation against the petitioner is that he has taken Rs. 11 lakh from the informant on execution of sale-deeds.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The informant and the petitioner was co-villager and due to enmity he has falsely been implicated in this case. It is not

Patna High Court CR. MISC. No.59896 of 2023(2) dt.08-09-2023 2/2 stated that in which presence cash or cheque was given to the petitioner by the informant. It is further submitted that it is a case of civil nature and no offence of u/s 420 and 406 are made out against the petitioner. He has got no criminal antecedent. Moreover, he is languishing in judicial custody since 29.06.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kahalgaon P.S. Case No. 65 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur.
