The petitioner apprehend arrest in Jhajha P.S. Case No. 41 of 2017 instituted for the offence under Sections 302, 120(B)/34 of the IPC and Section 27 of the Arms Act. It is alleged in the written report that co-accused Ghutar Yadav had caused fire arm injury on the brother of the informant, then he fell down. Thereafter, this petitioner caused injury on his face and near neck with sword. The brother of informant subsequently died on account of aforesaid injury. The case diary has been received, in which post-mortem report is available, wherein, total 6 injuries have been found on the person of deceased, caused by sharp cutting weapon and fire arm.

Patna High Court Cr.Misc. No.5304 of 2018(3) dt.27-02-2018 2/2 Keeping in view, the direct allegation against the petitioner, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, this anticipatory bail petition stands dismissed.

The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail which will be considered by the court below in accordance with law and disposed off preferably on same day, without being prejudiced by this order.
