The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition & Excise Act. There is recovery of 81 litres of illicit liquor from the hut of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. Though the hut belongs to the petitioner but the alleged hut is far away from his

Considering the fact that petitioner is owner of the hut from where which huge quantity of Indian made Foreign Liquor was recovered, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected.
