2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 103 (1) and 61 ( 2 ) of BNS and 27 of the Arms Act.
3. Prosecution case , in brief, is that informant namely Sahiba Praveen alleged that on 19.05.2025 , all the F.I.R. named accused persons including this petitioner fired on husband of informant due to which he died. The reason behind the alleged occurrence is that accused persons wanted to grab the land of deceased.
4. At the outset, learned Mr. Bindhayachal Singh appeared on behalf of informant and submitted that petitioner
Patna High Court CR. MISC. No.56391 of 2025(3) dt.26-09-2025 2/2 has been declared absconder and process of Section 82 and 83 of the Cr.P.C. has been initiated against him to ensure his appearance in the Court as such petitioner is not entitled to the relief of anticipatory bail (Lavesh v. State (NCT of Delhi) (2012) 8 SCC 730, State of MP v. Pradeep Sharma (2014) 2 SCC 17, Prem Shankar Prasad v. State of Bihar 2021 SCC OnLine SC 955).
5. Considering the aforesaid development, petition for pre-arrest bail of petitioner is dismissed as not maintainable . (Prabhat Kumar Singh, J) Koushik/- U T
