The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 32, 41, 56(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 120 litres of liquor was recovered from the motorcycle of the petitioner and he was taken into custody.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession or from his motorcycle. He has been falsely implicated in the case. He is in custody since 30.9.2021 and has no criminal antecedent.

No.67027 of 2021(2) dt.26-04-2022 2/2 Having heard learned counsel for the parties and taking into consideration the facts of the case especially the petitioner not having any criminal antecedent and having remained in custody for more than 6 months, the Court directs the petitioner to be enlarged on bail in connection with Excise Case no. 123C2 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum Special Judge, Excise, Lakhisarai.
