The petitioner seeks bail in Mohiuddinnagar P.S. Case No. 09 of 2016 instituted for the offences under Sections 302, 201, 120b and 34 of the Indian Penal Code.

The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that the gamcha which was used for strangulating the deceased was recovered on the confession of this petitioner which is evident from paragraph 26 of the case diary. A report was called for from the Court below. It has been reported that five witnesses have been examined. The I.O., the doctor and some other non-official witnesses are to be

Patna High Court Cr.Misc. No.10040 of 2018(3) dt.10-05-2018 2/2 examined as they are essential witnesses.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to conclude the trial within a period of nine months preferably on day to day basis from the date of receipt/production of a copy of this order.

The District Magistrate, Samastipur, the Superintendent of Police, Samastipur and the Civil Surgeon, Samastipur are directed to ensure that the prosecution witnesses are produced on the dates fixed by the Trial Court so that the trial could be completed within the stipulated period of time. Let this order be communicated to the District Magistrate, Samastipur, the Superintendent of Police, Samastipur and the Civil Surgeon, Samastipur. (Sudhir Singh, J) Pankaj/- U T
