JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 406, 409, 120B,34 of the Indian Penal Code.
Prosecution case is that the government solar lights were not installed during the years 2006-07 to 2010-11 in Bath panchayat, leading to registration of FIR against Panchayat Secretary, Mukhiya and the supplier.
It is submitted by learned counsel for the petitioner that the petitioner supplied solar lights worth Rs.1,04,749/- and Rs.42,766/- total amounting to Rs.1,47,515/- and most of the solar lights were found in working condition. Considering the same Panchayat Secretary of Bath has been granted anticipatory bail vide Criminal Miscellaneous No.34216/2014 whereas the others
Patna High Court Cr.Misc. No.14179 of 2016 (2) dt.31-03-2016 2/2 have been granted anticipatory bail on the undertaking to deposit the alleged involved amount vide Criminal Miscellaneous Nos.20012/24249/24236 of 2014. However, the petitioner is ready to deposit Rs.1,47,515/- before the learned Court below, subject to result of the present case.
On deposit of the aforesaid amount before the learned court below, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Jhanjharpur, Madhubani, in connection with Madhepur P.S. Case No.8/2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
The above amount on deposit will be invested in some fixed deposit scheme in connection with the present case and the same will be subject to the result of the case. (Dinesh Kumar Singh, J) Ashwini/- U T
