KUMAR ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in connection with Bishanpur P.S. Case No. 86 of 2016 instituted for the offences punishable under sections 363, 366(A) and 120(B)/34 of the Indian Penal Code.

It has been alleged that two minor daughters of informant aged about 5 years and 11 years were missing thereafter FIR was lodged against unknown. Upon recovery of both the victim girls, statement were recorded under section 164 Cr.P.C. where they have told that they voluntarily left the house. It has further been submitted that the petitioner has clean antecedent and similarly placed co-accused who are brothers of the petitioner have already been granted bail by a coordinate Bench of this

Patna High Court Cr.Misc. No.33190 of 2017 (2) dt.20-07-2017 Hon'ble Court vide Criminal Misc. No. 2616 of 2017 dated 15.3.2017. One of the co-accused Ram Sakhi Devi has also been granted bail in Criminal Misc. No. 52002 of 2016 dated 23.12.2016.

Considering the aforesaid facts and circumstances, let petitioner Harihar Yadav be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge (POCSO ACT), Darbhanga in connection with Bishanpur P.S.
