JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Aurangabad (Muffasil) P.S. Case No. 162 of 2013 registered for the offence punishable under Section 363/34 of the Indian Penal Code.
It appears that the case has been instituted under bailable section and the learned Sessions Judge directed the petitioners to surrender before the court below and seek regular bail but in spite of surrendering before the trial court, the petitioners approached to this court for grant of anticipatory bail.
Patna High Court Cr.Misc. No.1277 of 2015 (2) dt.13-01-2015 In my view, the conduct of the petitioners is not appreciable. However, this petition stands dismissed being not maintainable.
