JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 26-05-2016 The petitioner apprehends his arrest in relation to Lakhisarai (Kabaiya) P.S. Case No. 90 of 2016 registered under Sections 147, 148, 323, 504, 379, 307, 427 of the Indian Penal Code and under section 27 of the Arms Act.

Learned counsel for the petitioner submits that there is a case and counter case. Earlier the case was lodged by the petitioner in Lakhisarai (Kabaiya) P.S. Case No. 89 of 2016. There is pre-existing dispute between the parties, inasmuch as the petitioner's wife had already filed a Title Suit against the informant, which is pending in the Court of Sub-Judge, 1st Lakhisarai. It is only to implicate the petitioner, this case has falsely been made and there is no injury report on the record. Be that as it may, in the event of his arrest/surrender

Patna High Court Cr.Misc. No.15368 of 2016 (3) dt.26-05-2016 2/2 before the court below within four weeks, let the petitioner above named be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai (Kabaiya) P.S. Case No. 90 of 2016, subject to conditions laid down under Section 438(2) of the Code of Criminal Procedure.
