2. The petitioner apprehends his arrest in a case registered for the offence under Sections 126(2), 115(2), 118(1), 117(2), 109, 3(5) of B.N.S. and Sections 25(1-b)a, 26, 27 of the Arms Act and later on, Section 103 of B.N.S. was added in FIR.
3. It is alleged that all the F.I.R. other co-accused persons, including petitioner, armed with Lathi, Danda, Iron Rod & Firearms, brutally assaulted informant and other family members, due to which, they sustained injuries. It is further alleged that co-accused Gaurav Kumar fired from his pistol which hit the leg of Dwarika Yadav causing fire-arm injury.
4. Learned counsel for the petitioner submits that from bare perusal of the F.I.R., it would manifest that specific allegation of firing is against co-accused Gaurav Kumar. So far as this petitioner is concerned, there is general and omnibus
Patna High Court CR. MISC. No.60253 of 2025(2) dt.08-09-2025 2/2 allegation and no specific overt act has been alleged against him. Case and counter case. He further submits that similarly situated other co-accused persons have already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 11.07.2025 passed in Cr.Misc. No. 42253/2025 with Cr.Misc. No. 42275/2025 (Annexure P2/1) Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Sherghati, District - Gaya, in connection with Maigra P.S. Case No. 72 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
