JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioner was rejected by this Court vide order dated 20.03.2014 passed in Cr. Misc. No.29371 of 2013 and its analogous cases with direction to the trial court to expedite the trial of the petitioner but the trial court has reported that up till now only six prosecution witnesses could be examined and still six proposed prosecution witnesses have been left to be examined and to procure the attendance of remaining proposed prosecution witnesses process have already been issued.

Considering the aforesaid facts and circumstances as well as submission of the parties, I am not inclined to grant

Patna High Court Cr.Misc. No.2107 of 2015 (3) dt.11-03-2015 2/2 privilege of bail to the petitioner and accordingly, his prayer for bail in connection with session trial no. 183 of 2014 arising out of Sonbarsa P.S.Case No. 22 of 2013, pending in the court of A.D.J, FTC-II, Sitamarhi.

However, learned trial court is directed to conclude the trail of the petitioner within seven months from the date of receipt / production of copy of this order. Let copy of this order be also sent to Sessions Judge, Sitamarhi with direction to him to ensure the compliance of order of this Court.
