The petitioner apprehends her arrest for the offences alleged under Sections 363, 366 and 366(A) of the Indian Penal Code and Section 8 of the POCSO Act, registered in connection with Sadar Saharsa P.S.Case No. 780 of 2019. The learned counsel for the petitioner has submitted that the victim herself in her statement under Section 164 of the Cr.P.C. has stated that she has solemnized marriage with co-accused Rahul Kumar. The petitioner has falsely been implicated merely because she is the mother of co-accused Rahul Kumar.

Considering the above facts and circumstances, let

Patna High Court CR. MISC. No.55773 of 2022(2) dt.06-02-2023 2/2 the petitioner above-named, in the event of her arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Sessions Judge-cum-Spl. Judge, Saharsa in connection with Sadar Saharsa P.S.Case No. 780 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.

The facts submitted by the learned counsel for the petitioner shall be verified by the learned court below from the statement of the victim under Section 164 of the Cr.P.C.
