JUSTICE ARUN KUMAR ORAL ORDER 19-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 8.8.2017, seeks bail in Palanwa PS Case No. 94 of 2013, S.T. No. 88 of 2018/ Supplementary No. 9 of 2018 registered under Sections 395 and 412 of the IPC.

Learned Counsel for the petitioner submits that the FIR is against unknown and except disclosure of name of the petitioner in the confessional statement of Chhote Lal Paswan and Govind Kumar Ojha there is no other material against him, moreover Chhote Lal Paswan was put on trial earlier and also acquitted in that case. Having considered the said facts and circumstances, the petitioner, namely, Ashish Da @ Ashish Sah @ Ashish is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, 9th, Motihari, East Champaran in connection with Palanwa PS Case No. 94 of 2013, S.T.
