The petitioner seeks regular bail in connection with Chautarwa (Bathwariya) P.S. Case No. 113 of 2016 for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

The allegation is regarding elder brother of the informant having gone to distribute marriage card but subsequently when he did not return, on being searched, his dead body was found.

The learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., there is no evidence to connect the petitioner to the alleged crime and his name has merely transpired on the confessional statement made by one

Patna High Court Cr.Misc. No.30782 of 2018 (4) dt.19-07-2018 2/2 Suresh Yadav who has already been granted bail by this Court vide order dated 22.11.2017 passed in Cr. Misc. No. 52459 of 2017. The petitioner is stated to be having fair antecedent barring one case under the Excise Act, in which he is on bail. The petitioner is stated to be languishing in custody since 19.03.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Bagaha, District- West Champaran in connection with Chautarwa (Bathwariya) P.S. Case No. 113 of 2016.
