JUSTICE PRABHAT KUMAR JHA ORAL ORDER 10-04-2015 Learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application of petitioner no.1, Ram Sajjan Ram, as he has already been arrested by the police. Therefore, the anticipatory bail application of petitioner no.1 is dismissed as having become infructuous.

Heard both sides.

Petitioner Dulari Devi, mother-in-law of the deceased, apprehends her arrest in a case under section 304(B) and other sections of the Indian Penal Code. The mother of the deceased alleged that her daughter was married to Bhikhari Ram, but Bihkhari Ram was pressurizing her daughter to get the land transferred in his name. The informant did not make any allegation against the petitioner.

Considering the aforesaid facts and the nature of the

No.50177 of 2014 (3) dt.10-04-2015 2 / 2 allegations made against the petitioner, and the fact that the petitioner is mother-in-law of the deceased, it is directed that in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, the above named petitioner Dulari Devi @ Ram Dulari Devi shall be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in Minapur P.S. Case No. 143 of 2014, subject to the conditions as laid down under section 438(2) Cr.P.C.
