Perused the impugned order. The learned Additional Sessions Judge-IV, Aurangabad has rejected the petition dated 25.11.2013 under Section 227 Cr.P.C. filed on behalf of the petitioner. Learned counsel for the petitioner submits that no case under Section 376 of the Indian Penal Code at least would be made out from the materials on record.

This Court has perused the materials available on the record before this Court and the impugned order passed by the learned court below. It has been mentioned by the learned court below in the

Patna High Court Cr.Misc. No.49534 of 2014 dt.13-10-2017 impugned order that the witnesses examined under Section 161 Cr.P.C., statement of victim under Section 164 Cr.P.C. and the medical examination of the victim are supporting the prosecution and, therefore, there are sufficient grounds to proceed against the accused petitioner.
