JUSTICE SUDHIR SINGH ORAL ORDER 02-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 420, 467, 468, 469 and 471/34 of the Indian Penal Code.

Allegation against the petitioner is that he joined as Assistant Teacher in both the districts Jehanabad and Patna. It is submitted on behalf of the petitioner that he has got no criminal antecedent. He has been appointed as Assistant Teacher at Jehanabad as well as Patna. Subsequently, within a period of twelve days of his service at Patna he tendered his resignation at Patna vide Annexure-4 series. From perusal of Annexure-5 it is evident that he did not draw any salary as far as his appointment at Patna is concerned and he continued with his service at Jehanabad. Subsequently, he has been terminated from the service at Jehanabad also. The present case has been instituted against the petitioner due to mistake of fact.
