In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 498 A and 34 of the I.P.C.
The petitioner being husband of the informant whose marriage has taken place about four years ago started demanding cash of Rs. 2,00,000/- from her and on refusal she was assaulted by the petitioner and others and after snatching all her articles she was ousted from her in-laws house. The informant has also given birth of a child from the wedlock but the petitioner is not ready to keep her.
Patna High Court Cr.Misc. No.50513 of 2014 (2) dt.07-05-2015 2/2 Submission is of false implication and that the petitioner has filed a case under section 9 of the Hindu Marriage Act and he is always ready to keep her with all dignity and comfort but she does not want to live with him as she likes to live at Kolkatta.
The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner.
Considering that the petitioner is husband and against him there is allegation for committing torture and demanding cash of Rs. 2,00,000/- and as such this Court is not persuaded to grant privilege of pre-arrest bail to the petitioner and accordingly his such prayer stands rejected in connection with Singhwara P.S. Case No. 164 of 2013 pending in the court of C.J.M. Darbhanga. (Jitendra Mohan Sharma, J) Abhay/- U T
