JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-02-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sessions Trial No. 75 of 2013 arising out of Mufassil P.S. Case No. 300 of 2012 registered under Sections 341, 323, 324, 326, 307, 498(A), 504 and 506/34 of the Indian Penal Code and subsequently, Sections 302 and 304B of the Indian Penal Code were also added.

Learned counsel for the petitioner submits that prayer for bail of the petitioner, who is the husband of the deceased, was earlier rejected on merit vide order dated 25.06.2014 passed in Cr. Misc. No. 25103 of 2014 by this Court

Patna High Court Cr.Misc. No.2696 of 2015 (2) dt.18-02-2015 with direction to the trial court to expedite the trial of the petitioner and conclude the trial within a period of six months from the date of receipt of this order. If the trial of the petitioner is not concluded within the aforesaid period of six months, the petitioner shall renew his prayer for bail and he is in custody since 11.12.2012. It is further submitted that only seven witnesses have been examined but two official witnesses have not been examined till 30.12.2014, which would appear from the order sheets of the Sessions Trial No. 75 of 2013 pending in the court of First Additional Sessions Judge, Samastipur.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I, Samastipur in connection with Sessions Trial No. 75 of 2013 arising out of Mufassil P.S. Case No. 300 of 2012.
