JUSTICE BIRENDRA KUMAR ORAL ORDER 15-05-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 147/341/323/504/324/307/379 of the Indian Penal Code.

For land dispute allegation against the petitioner is that he assaulted to Md. Salim with a sharp cutting weapon causing injury at the head. The doctor has found clean incised wound at the left parietal region of Md. Salim. However, opinion regarding nature of injury is still reserve.

Submission is that the petitioner is in custody since 11.12.2017. There is no allegation of repetition of blow. Investigation of the case is already closed and the awaited opinion

Patna High Court Cr.Misc. No.15407 of 2018 (4) dt.15-05-2018 P2/ of the doctor is still awaited even after closure of the investigation. Considering the entire facts aforesaid, let the petitioner, above named, be released on bail after completion of six months of custody on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Jogbani (Bathnaha) P.S. Case No.59 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
