The petitioner apprehends his arrest for the offences alleged under Section 302/34 of the Indian Penal Code, registered in connection with Chandi P.S.Case No. 92 of 2022. The son of the informant was going to railway station driving his tempo. From opposite side, an e-rickshaw, in which five persons were present, was collided with the tempo driven by the son of the informant. Those five persons named in the FIR including the petitioner, badly assaulted the tempo driver, who died during the course of treatment. Patna High Court CR. MISC. No.56348 of 2022(2) dt.07-02-2023 2/2 post-mortem report shows that one hematoma and swelling were found on the head and face of the informant's son. Except that, there is no injury on the person of the deceased. The petitioner is named in the FIR. There is specific allegation that he along with his four associates badly assaulted the tempo driver resulting in his death. In my view, it is not a fit case for anticipatory bail to the petitioner.
