The petitioner apprehends his arrest in a case registered for the offence under Sections 302, 120(B) r/w 34 of the Indian Penal Code.

As per the prosecution case, on 31.05.2022, while the informant alongwith his uncle Birendra Singh and others were engaged in spreading soil, it is alleged that all the accused persons came there and made indiscriminate firing, as a result of which, uncle of informant namely Birendra Singh received gun shot injury and died, during course of treatment. It is submitted on behalf of petitioner that specific accusation of causing fire-arm injury is against co-accused

Patna High Court CR. MISC. No.55854 of 2022(2) dt.17-03-2023 2/2 Vikash Kumar @ Nepali. Though, petitioner is alleged to have fired upon the informant, but it did not hit him (informant). Petitioner has got clean antecedent.

Learned A.P.P. for the State and learned counsel for the informant vehemently oppose the prayer for anticipatory bail and submit that during course of investigation, it has come that this petitioner had given supari (contract) to the co-accused to kill the deceased.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VIII, Bhojpur, Ara in connection with Piro P.S. Case No. 280 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
