JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2018 Heard both the parties. The petitioner seeks regular bail in connection with Sessions trial No. 94 of 2017 arising out of Revilganj P.S.Case No. 189 of 2016 for the offence under Sections 341, 323, 307 and 504/34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.
Earlier prayer for bail of the petitioner was twice rejected vide order dated 18.03.2017 passed in Cr. Misc. No.7656 of 2017 and order dated 18.10.2017 passed in Cr. Misc. No. 49848 of 2017 with a direction to expedite the trial and conclude it within a period of four months It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.16568 of 2018 (3) dt.16-05-2018 2/3 the petitioner is in custody since 24.11.2016 and trial has not concluded up till now.
Heard learned A.P.P. and perused the report and it appears that in eight witnesses, five witnesses have already been examined and now one private witness and two official witnesses including doctor and I.O. has to be examined. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned II Additional Sessions Judge, Chapra, District- Saran in connection with Sessions Trial No. 94 of 2017 arising out of Revilganj P.S.Case No. 189 of 2016, subject to the conditions that one of the bailors of the petitioner must be a local person having sufficient immovable property within the jurisdiction of the concerned Court and he will cooperate in the disposal of the trial, failing which his bail bond will be cancelled.
