The petitioner is apprehending his arrest in connection with Shastri Nagar P.S. Case No. 42 of 2014 for the offences instituted under Sections 147, 148, 427, 384, 504, 452 and 379 of the IPC.

The prosecution story, in brief, is that the petitioner alongwith unknown persons variously armed with Pistol, Khanti, Iron rod etc., abused the informant and told why the informant instituted cases after cases and damaged the wall. They demanded extortion money Rs. 20,00,000/- or asked to execute the sale deed in respect to the land. They took way the bricks after breaking the wall.

Patna High Court Cr.Misc. No.15457 of 2016 (2) dt.02-05-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. There is admitted land dispute between the parties. In respect to the land in question, a Jamabandi proceeding was also initiated before the D.C.L.R. Hence, a false case was instituted by the informant. The matter relates to the civil dispute.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Shastri Nagar P.S. Case No. 42/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
