JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 This application, for grant of anticipatory bail, arises out of Imamganj P.S. Case No. 139/2018, disclosing offences under Sections 420, 467, 468, 471, 196, 198, 199, 201, 129B of the Indian Penal Code.

Petitioner happens to be Block Development Officer and Secretary of Block Employment Committee and there is allegation that without verifying the documents of one Ranjan Kumari, he got her appointed as teacher.

Submission of learned counsel for the petitioner is that he has sent the papers to the Block Employment Committee and after approval of the same, order of appointment has been issued and he has no role to play.

Having heard both sides, considering the facts and circumstances, let petitioner, above named, surrender before the court below within two weeks from the date of receipt of a copy this order, on which, the court below shall release the petitioner on bail till submission of charge-sheet on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Gaya, in connection with Imamganj P.S. Case No. 139/2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. Further condition is that petitioner will appear before the Investigating Officer and explain the entire facts and circumstance, however, in spite of that if the charge-sheet is submitted against the petitioner, he has to surrender in the court below and make prayer for regular bail.

With the above observation and direction, this application is disposed of.
